Something to ask your process server: What is your rate of success?

Always ask possible process server about their rate of success. If the server makes the claim to have a 100% success rate – be very wary. No one can guarantee service every time, as there are often obstacles that one simply cannot overcome. However, a server should have a fairly high rate of success in delivering court papers and documents.

There will be instances when recipients of court documentation will be evasive and even hostile. Moreover, defendants may live in remote locations (or overseas) and you could be faced with allegations of non-delivery or non-receipt of legal documentation. To successfully accomplish the required process serving tasks the experience of an accredited process server may be required. In some instances, successfully serving official court papers can result in an out-of-court agreement. This may, or may not, be the desired outcome depending on the customer’s specific requirements.
