WHAT IS PROCESS SERVING?

Process serving is the procedure that needs to be adhered to in filing and serving legal documents and in document retrieval in connection with civil and criminal court law cases.  A process server delivers or “serves” legal documents to a defendant or a person involved in a court case.

WHY IS PROCESS SERVING IMPORTANT?

Civil Procedure Rules dictate that, once the delivery of court documentation is properly executed, the onus is on the recipient to comply with a court order, such as a subpoena. As such, defendants can often go to great lengths to avoid being served court documents. Performing a legal and thorough process serving activity ensures that appropriate notice is given to a defendant, therefore enabling the smooth running of legal proceedings.

WHEN CHALLENGES ARISE

There will be instances when recipients of court documentation will be evasive and even hostile. Moreover, defendants may live in remote locations (or overseas) and you could be faced with allegations of non-delivery or non-receipt of legal documentation. To successfully accomplish the required process serving tasks the experience of an accredited process server may be required. In some instances, successfully serving official court papers can result in an out-of-court agreement. This may, or may not, be the desired outcome depending on the customer’s specific requirements.
